Public Protector meets Executive Mayor of Cape Town

The Public Protector of South Africa, Advocate Busisiwe Mkhwebane, met the Executive Mayor of Cape Town following a subpoena which was issued by the Public Protector in terms of Section 7 (4) and 5 of Public Protector Act, 1994 on the investigation into alleged maladministration, undue delay and improper prejudice as a result of inadequate provision of basic services by the City of Cape Town.

The Public Protector clarified that the subpoena should not be viewed as being antagonistic, but is intended to ensure attendance due to the urgent need to resolve the matter under investigation, which affects the livelihood of the Masiphumelele community which is plagued by overcrowding and poor living conditions.

The Public Protector has decided to resolve the complaint from Masiphumelele through Alternative Dispute Resolution process, as provided for in terms of the Public Protector Act.

It was resolved in the meeting that the Public Protector and the City of Cape Town Mayor will work together in resolving the poor living condition of Masiphumele community.

In terms of the above resolution, a settlement agreement, with the City of Cape Town will be concluded in the next three weeks and the Public Protector will monitor the implementation thereof

Lastly, the City of Cape Town Mayor and the Public Protector also agreed that the Public Protector will also act as a mediator between the City of Cape Town and Masiphumelele community in order to get the issues resolved and the community to live in a manner that protects their human rights and dignity.
