Public Protector to conduct preliminary
investigation on ‘abuse of power’ allegations levelled
against Mdluli

Public Protector Adv. Thuli Madonsela has decided
to conduct a preliminary investigation into allegations of
abuse of power levelled against suspended Head of Police
Crime Intelligence Lieutenant-General Richard Mdluli, by the
Minister of Human Settlement, Tokyo Sexwale.
This followed a complaint lodged by Minister Sexwale through
his legal representatives pertaining to an alleged
investigation and a resultant report thereof compiled or
authorised by Lieutenant Mdluli, in which it is alleged that
the Minister is part of a plot to oust President Jacob Zuma.
As part of the preliminary investigation, the Public
Protector will engage with among others, the complainants in
the Freedom Under Law (FUL) litigation to establish if the
process includes allegations of abuse of office by Mdluli.
The Public Protector will also engage with the Inspector
General of Intelligence Adv. Faith Radebe, to assess
progress made in the investigation of the matters referred
to her.
Last month, the Public Protector said she would wait for the
Inspector-General of Intelligence to conclude her own
investigation into Mdluli’s alleged abuse of the Secret
Intelligence funds, before deciding on a request for an
investigation made by the Democratic Alliance and the FW De
Klerk foundation.
